These Terms of Service ("Terms") govern your access to and use of the services provided by OnPath Testing, Inc. ("OnPath," "we," "us," or "our") through our website and platform at onpath.software. By using our services, you agree to be bound by these Terms.
1. Service Description
OnPath provides AI-powered code quality auditing and a QA platform designed to help development teams ship better software. Our services include:
- Free code audits — automated analysis of public GitHub repositories across five quality dimensions: security, architecture, dependencies, process maturity, and performance
- QA platform — a comprehensive suite of tools for managing audits, tracking findings, and improving code quality over time
2. Eligibility
To use our services, you must:
- Provide a valid email address
- Have authorization to submit the repository for audit — you must be an owner, maintainer, or have explicit permission from the repository owner
- Be at least 18 years of age or the age of majority in your jurisdiction
3. Acceptable Use
You agree not to use our services to:
- Submit repositories you do not have authorization to audit
- Attempt to disrupt, overload, or interfere with our services or infrastructure
- Use audit results for malicious purposes, including identifying vulnerabilities in code you do not own for the purpose of exploitation
- Circumvent rate limits or access controls
- Impersonate another person or entity
- Violate any applicable laws or regulations
4. Free Audit Terms
The free code audit service is subject to the following conditions:
- Public repositories only — free audits are limited to publicly accessible GitHub repositories
- Rate limits — free audits are limited to 3 requests per hour per user
- Data retention — audit results are retained for 365 days from the date of the audit, after which they are automatically deleted
- Availability — the free audit service is provided on a best-effort basis and may be modified, suspended, or discontinued at any time
5. Guest Accounts
When you submit a free audit, a guest account is automatically created for you. Guest accounts provide:
- View-only access to your audit results and findings
- Access to basic audit dashboard features
Full platform features — including team management, audit history, trend tracking, ticket creation, and integrations — require a paid plan. Guest accounts are subject to the same data retention period as audit results (365 days).
6. Intellectual Property
Your code: You retain all rights to the source code in the repositories you submit. We do not claim any ownership over your code. We access your repository data solely to perform the audit and do not store your source code beyond what is necessary to complete the analysis.
Audit results: The audit reports, scores, findings, and recommendations generated by our platform are the intellectual property of OnPath Testing, Inc. You are granted a non-exclusive license to use your audit results for your internal purposes.
7. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Specifically:
- Audit results are informational only and do not constitute professional security advice, legal compliance certification, or a guarantee of code quality
- We do not guarantee that our audits will identify all issues, vulnerabilities, or defects in your code
- We make no warranties regarding the accuracy, completeness, or reliability of audit results
- We do not guarantee uninterrupted or error-free service availability
8. Limitation of Liability
To the maximum extent permitted by applicable law, OnPath Testing, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services.
Our total aggregate liability for any claims arising from your use of the services shall not exceed the amount you paid to OnPath in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless OnPath Testing, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services or violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use the services ceases immediately, though provisions that by their nature should survive termination will remain in effect.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Boulder County, Colorado.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the services after any changes constitutes your acceptance of the revised Terms.
